Texas Court to Consider Motion to Dismiss Murder Charge in Suzanne Simpson Case

A Texas court will hear a motion next month from Brad Simpson, the husband of Suzanne Simpson, to dismiss the murder charge against him in connection with her disappearance and death.

Suzanne Simpson, a 51-year-old mother of four, went missing on October 6, 2024, after reportedly arguing with her husband of 22 years, Brad Simpson, in front of their home in Olmos Park, near San Antonio. Authorities believe Brad "intentionally and knowingly caused the death" of Suzanne "on or about Sunday, Oct. 6," according to records.

During a court hearing on Wednesday, Brad Simpson’s attorney, Steven Gilmore, stated that he has "enough evidence to proceed with the motion to quash" the indictment, which charges Brad with murder, tampering with evidence, and prohibited weapons possession.

"I would just ask for a hearing on that within 30 days," Gilmore said.

Brad Simpson is scheduled to appear in court on April 22 at 9 a.m. The hearing was rescheduled from February, as both prosecutors and Simpson’s defense attorney requested more time to review discovery materials.


Details of the Case

On the night of October 6, the Simpsons and their five-year-old daughter attended a party at The Argyle, an exclusive club in Alamo Heights. Witnesses reported seeing the couple in a "verbal altercation" during the event, according to an arrest affidavit.

After the party, Suzanne and her daughter reportedly went to a grocery store before returning home. Later that evening, Suzanne called a family friend to say she was stopping by and then called her mother to report that Brad had assaulted and injured her.

Around 10 p.m., a neighbor observed Brad and Suzanne arguing loudly and "physically struggling" in front of their home. The neighbor saw Suzanne "attempting to get away from Mr. Simpson’s grasp as he tried to pull her downwards." The neighbor later heard screams coming from a wooded area across from the home.

About an hour after witnessing the altercation, the same neighbor saw Brad’s truck leave the area and return approximately an hour later.


Surveillance Footage and Evidence

The next day, surveillance footage allegedly captured Brad driving his truck with trash bags, a heavy-duty trash can, an ice chest, and a "large bulky item wrapped and secured in a blue tarp" held down by a firewood rack. Later footage showed Brad at a gas station, but the trash bags were no longer visible in his truck.

Brad was also seen purchasing two bags of cement, a construction bucket, heavy-duty trash bags, Clorox disinfectant spray, and insect repellent with cash at a Home Depot. After picking up his daughter from school, he was observed washing his truck.

Suzanne’s friend reported her missing on the evening of October 7. When police contacted Brad about her disappearance, he allegedly claimed he had not seen her since around 11 p.m. on October 6.


Text Messages and Additional Charges

On October 8, Brad exchanged text messages with his longtime friend and business partner, James "Val" Cotter, who is also charged in the case.

"If you’re in Bandera, can you haul a– to meet me at your house?" Brad allegedly texted Cotter. "I don’t have much time."

Cotter responded, "Get over here!! I won’t tell anyone" and "You’re my brother."

Cotter was charged with tampering with evidence and possession of prohibited weapons in connection with Suzanne’s disappearance. He posted bond in November 2024.


Arrests and Further Investigation

Brad Simpson was arrested on October 9, 2024, and Cotter on October 21, 2024. Investigators later found a ground-level burn site on Simpson’s property in Bandera County, containing a burnt laptop and multiple cellular devices. Stains in Brad’s truck tested "presumptively positive for blood," which was later confirmed to be his own.

In December, Bexar County Criminal District Attorney Joe Gonzales announced that Brad had concealed a "reciprocating saw" two days after Suzanne’s disappearance. Authorities informed family members that Suzanne’s DNA had been identified on the saw.


Current Status

Brad Simpson remains in Bexar County’s jail with bonds totaling $3 million and a federal hold by the Bureau of Alcohol, Tobacco, Firearms and Explosives for the weapons charge. His attorney could not be reached for comment.
